The Xpax™ Prepaid

This Service(s) (as hereinafter defined) is made available by Celcom subject to the general terms and conditions and the specific terms and conditions of each Service provided herein (“Terms and Conditions”). You acknowledge that you have read and fully understood these Terms and Conditions. Your use of the Service, upon Activation, constitutes unconditional acceptance to be bound by these Terms and Conditions as may be amended from time to time. You must ensure that any person you allow to use the Service complies with these Terms and Conditions. 

In the event of any inconsistency between the English version and the Bahasa Malaysia version of these Terms and Conditions, the English version shall prevail.

Part A:    General Terms and Conditions (“GTC”)

  1. Definitions
    For the purpose of these Terms and Conditions, the following terms shall, unless the context otherwise requires, have the meanings as defined below. All other terms not defined herein shall have the meaning as may generally be accepted within the industry based on the context used herein:
    “Account” means an account opened for you with Celcom for subscribing to the Service. 
    “Activation” or “Activated” means the point in time when the Service is activated in Celcom’s System.
    “Addendum” means any addendum(s) executed by you and accepted by Celcom for value added, supplemental or additional Services.
    “Agreement” means the completed Registration Form and these Terms and Conditions including any Addendum and all subsequent amendments and variations to the Terms and Condition and Addendum.
    “Celcom” means Celcom Mobile Sdn Bhd (Company No. 27910-A)
    “Celcom’s System” means the telecommunication system utilised by Celcom in providing the Service
    “Content” means any contest, java games, information, text, sound, music, software, photographs, videos, graphics, data messages or other materials received by you including but not limited to VAS
    “Donor Network Operator” or “DNO” means a mobile service provider from which a Mobile Number has been or is to be ported out. 
    “Mobile Device” means a wireless  device together with accessories for the use of the Service.
    “Mobile Number” means the mobile number assigned to you by Celcom.
    “Mobile Number Portability” or ”MNP” means your ability to change from one mobile service provider to another and retain your Mobile Number.
    “User” refers to you or in the case of a company, any person nominated by the company to be the User. 
    “Recipient Network Operator” means a mobile service provider to which a Mobile Number has been or is to be ported in. 
    “Registration Form” refers to Xpax Registration Form duly completed by you to subscribe to the Service, which has been accepted and approved by Celcom. 
    “Service(s)” means mobile telecommunication services to be provided by Celcom to you pursuant to the Agreement.
    “SIM Card” means the microprocessor card provided by Celcom which is inserted into the Mobile Device and contains a personal identification number (PIN) for access into the Service. 
    “SKMM” means Suruhanjaya Komunikasi dan Multimedia Malaysia also known as the Malaysian Communications and Multimedia Commission, established under the Communication and Multimedia Commission Act 1998.
    “Starter Kit” means the pack sold by Celcom containing the SIM Card and a user guide.
    “Terms and Conditions” means the general terms and conditions and the specific terms and conditions of each Service as may be varied or modified from time to time at Celcom’s sole discretion. For the avoidance of doubt, policies, procedures and user guide in the Starter Kit shall also constitute the Terms and Conditions. 
    “Value Added Service” or “VAS” means additional functions, features or facilities which are currently available or will be made available by Celcom from time to time and may be subscribed to and/or used by you in connection with the Service to enable you to access and use information, data, content, WAP and other interactive applications and/or services over the internet and/or intranet.
    “Working Days” means save for the states of Kedah, Terengganu and Kelantan, Mondays to Fridays excluding public holidays and Sundays. In the states of Kedah, Terengganu and Kelantan, Saturdays to Wednesday and Thursday (half day), excluding public holidays and Fridays. 
    “You” or “Your” refers to the person aged eighteen (18) years and above and authorised to use the Service subject to these Terms and Conditions herein and/or an entity of whatsoever description including but not limited to a sole proprietorship, a partnership, a body corporate or otherwise governmental bodies and agencies of any kind established under the laws, rules and/or regulations for the time being in force and which may come in force more particularly described in the Registration Form. 
  2. Period of Agreement

    1. This Agreement shall take effect from the Activation date of the Service and shall continue to be in force until terminated in accordance with these Terms and Conditions.

  3. Your Responsibility

    1. You shall:

      1. ensure the compatibility of your Mobile Device with Celcom’s System. In the event that changes and upgrades are introduced to Celcom’s System, you shall be responsible to ensure the continued compatibility of your Mobile Device and you shall have no claim whatsoever against Celcom arising thereform;

      2. comply with all notice or instruction given by Celcom from time to time in relation to the use of the Service and the SIM Card;

      3. ensure that the Mobile Device used with the SIM Card is legally owned by the User;

      4. be responsible for all equipment and software necessary to use the Service and also for the security and integrity of all information and data transmitted, disclosed and/or obtained through the use of the Service;    

      5. be fully responsible for any voice or data transmitted or broadcasted by you or persons using your Mobile Device;

      6. keep your personal identification number (PIN) of your SIM Card confidential at all times and not release the PIN to any person;

      7. comply with all applicable laws of Malaysia relating to the Service, including without limitation to the Communication and Multimedia Act 1998 and its subsidiary legislation, other acts, statutes, by-laws, rules and regulations issued by relevant government and regulatory agencies which may be amended from time to time; 

      8. take all reasonable steps to prevent fraudulent, improper or illegal use of the Service;

      9. cease to utilise the Service or any part thereof for such period as may be required by Celcom;

      10. report immediately to Celcom upon the discovery of any fraud, theft, loss, unauthorised usage or any other occurrence of unlawful acts in relation to the Mobile Device and its use. You agree to lodge a police report whenever instructed by Celcom and to give Celcom a certified copy of such report; and

      11. indemnify and shall keep indemnified Celcom from any loss, damage, liability or expense, arising from any claims for libel, invasion of privacy, infringement of copyright, patent, breach of confidence or privilege or breach of any law or regulation whatsoever arising from the Content transmitted, received or stored via the Service or part thereof and for all other claims arising out of any act or omission of your or any unauthorised use or exploitation of the Services or part thereof. 

    2. You shall not use the Service:

      1. to cause embarrassment, distress, annoyance, irritation, harassment, inconvenience, anxiety or nuisance to any person;

      2. to cause excessive or disproportionate load on the Service or Celcom’s System;

      3. for any unlawful purposes including but not limited to vice, gambling or other criminal purposes whatsoever or for sending to or receiving from any person any message which is offensive on moral, religious, communal or political grounds, or is abusive, defamatory or of an indecent, obscene or menacing character;

      4. for any purpose which is against public interest, public order or national harmony;

      5. use, permit or cause to be used the Service improperly or for any activities which breach any laws, infringe a third party’s rights, or breach any directives, content requirements or codes promulgated by any relevant authority including activities which will require Celcom to take remedial action under any applicable industry code or in a way interferes with other users or defames, harasses, menaces, restricts or inhibits any other use from using or enjoying the Service or the internet; or

      6. to transmit or post any content that contains any harmful, damaging or destructive programs.

  4. Celcom’s Rights
     
    1. Celcom reserves the right to make any alteration or changes to the Service, or any part thereof, or suspend the Service or any part thereof without prior notice and Celcom shall not be liable for any loss or inconvenience to you resulting therefrom.
       
    2. Celcom reserves the right at its absolute discretion, from time to time, to vary, add to or otherwise amend these Terms and Conditions or any part thereof, and such amendments shall be published on Celcom’s website. Your continued use of the Service after the effective date of any variation, addition or amendments to these Terms and Conditions shall constitute your unconditional acceptance of such variations, additions or amendment.
       
    3. Unless otherwise notified by you, you agree that Celcom may send you notifications relating to promotional and marketing activities from time to time.
       
    4. Celcom may extract any Short Message Service (SMS) details or Personal Information or any other data from you which is required to be used as evidence in court and/or when necessary in the event of a suspected and or proven misuse of the Service.
       
  5. Personal Information
     
    1. You agree that by executing the Registration Form or by continuing to use the Services, you are giving consent to Celcom that the information collected by Celcom from you (“Personal Information”) will be used and/or disclosed in accordance to our Privacy Notice as posted on our website at (http://www.celcom.com.my/personal/policy) and Personal Data Protection Act 2010. You are advised to read our Privacy Notice to understand your rights with regards to your Personal Information.
       
  6. Disclaimer
    1. This Service is provided on an “as is” and “as available” basis. Celcom disclaims all liability and makes no express or implied representation or warranties of any kind in relation to the Service including but not limited to: 
       
      1. availability, accessibility, timeliness and uninterrupted use of the Service; and
         
      2. sequence, accuracy, completeness, timeliness or the security of any data, Content or information provided to you as part of the Service.
    2. Notwithstanding Clause 6.1, above, the availability and speed of the Service shall be subject to the following:

      1. Celcom’s network availability;

      2. the Mobile Device and WiFi enabled device capability, including but not limited to the coverage, location, use of the WiFi enabled device, Celcom’s network traffic and the type of data being transmitted by you;

      3. the traffic and the volume of users using the Service; and

      4. your connection to the Service by using a WiFi enabled device.

  7. Celcom’s Liability 

    1. Celcom shall not be liable for any costs, loss or damages (whether direct or indirect), or for loss of revenue, loss of profits or any consequential loss whatsoever as a result of your usage of the Service or for whatsoever reason under the Agreement

    2. Notwithstanding the foregoing, you agree that Celcom’s entire liability in contract, tort (including negligence or breach or statutory duty) or otherwise to you (except for death or personal injury caused by Celcom’s negligence), shall not at any time exceed the sum of RM500.00 or the total of your charges in the three (3) months preceding the relevant event(s), whichever is lower.

  8. Content

    1. The Content provided by Celcom via the VAS is provided by Celcom or third parties. Celcom does not filter or edit the Content. You acknowledge that Celcom is under no obligation to censor the Content or information provided even if it is co-branded or promoted by Celcom. By using the VAS, you acquire no rights or interests to the Content and you agree not to distribute the Content to third parties.

  9. SIM Card

    1. The SIM Card shall remain the property of Celcom at all times and shall not at any time pass to you. Celcom grants you the right to use the SIM Card for the purposes of the Service. The SIM Card must be returned to Celcom on demand. Risk passes to you immediately upon the execution of this Agreement.

    2. The Service and/or features to be provided under the SIM Card will depend on the type of Mobile Equipment used. 

    3. You must not transfer the SIM Card to any other person without Celcom’s prior written consent. 

    4. In the event of loss, theft, cloning and/or unauthorised use of the SIM Card, you shall immediately notify Celcom. Replacement of a SIM card is subject to such payments as may be prescribed by Celcom. 

    5. Celcom shall only replace a defective SIM Card at no cost if the defect is proven to Celcom’s satisfaction to be caused by the manufacturer or supplier provided that you return such defective SIM Card to Celcom within fourteen (14) days from the date the Service is Activated.

  10. Governing Law

    1. The Agreement shall be governed and construed in accordance with the laws of Malaysia and parties agree to submit to the exclusive jurisdiction of Malaysian courts.

    2. Subject to Clause 10.1 above, this Agreement is subject to the Communications and Multimedia Act 1998 and any applicable subsidiary legislation, rules, regulations, directives and/or orders. 

  11. Notices

    1. Any notice, correspondence and/or other documents to be given by Celcom to you shall be in writing and sent to you at the address on the Registration Form or to your last known address, as the case may be.

    2. Any notice, correspondence, and/or other documents to be given by you to Celcom under the Agreement must be in writing and sent to the following address: Celcom Mobile Sdn Bhd, 21st Floor, Menara Celcom, No. 82, Jalan Raja Muda Abdul Aziz, 50300, Kuala Lumpur or feedback@celcom.com.my or such address as notified in writing by Celcom to you. 

    3. Any notice, correspondence, and/or other documents given by Celcom to you pursuant to this clause shall be deemed to have been served if:-

      1. sent by registered post, on the second Working Day after the date of posting irrespective of whether it is returned undelivered; 

      2. sent by ordinary post, on the fifth Working Day after the date of posting irrespective of whether it is returned undelivered; 

      3. hand delivered, upon delivery; or

      4. sent by facsimile, upon successful completion of transmission as evidence by a transmission report and provided that notice shall in addition thereon be sent by post to the other party.

  12. Assignment

    1. You shall not assign or novate any or part of your rights or obligations under the Agreement to any party, without Celcom’s prior written consent.

    2. Celcom may assign or novate all or part of the Agreement to any third party by notice to you without your prior consent.

  13. Indulgence and Waiver

    1. Any failure by Celcom to enforce any terms herein, or any forbearance, delay or indulgence granted by Celcom to you will not be construed as waiver of Celcom’s rights provided under this Agreement.

  14. Suspension and Termination

    1. Celcom shall be entitled at its absolute discretion to immediately suspend/terminate the Services or Agreement, without liability, at any time, without any notice and may not be required to give any reason whatsoever, including but not limited to the following reasons:

      1. if any technical failure occurs in the Services or Celcom’s System; 

      2. while the Service is being upgraded, modified or maintained; 

      3. if you breach any of the Terms and Conditions; 

      4. if you do anything which may in Celcom's opinion, lead to, including but not limited to damage  to the Services and/or Celcom’s System or losses to Celcom; 

      5. if Celcom is required to comply with an order, instruction or request of regulatory authority, government authority or any other competent authority; or

      6. if it is in Celcom's opinion that the Service or Celcom’s System is or may be used fraudulently, illegally or for unlawful purposes. 

    2. Celcom will endeavour to resume the Service as soon as reasonably possible if suspension or disconnection occurs for the reasons set out in Clause 14.1(a) and (b) above. You shall be liable for all applicable charges during the period of interruption, suspension or loss of the Services or part thereof from any cause whatsoever.

  15. Miscellaneous

    1. No rule of construction or interpretation shall apply to prejudice the interest of the party preparing the Agreement.

    2. In the event of a conflict or inconsistency between the Registration Form, the Terms and Conditions and the Addendums, such inconsistency shall be resolved by giving precedence in the following order: Addendums, the Terms and Conditions and the Registration Form.

    3. The Agreement constitutes the entire agreement between the parties concerning the subject matter herein and supersedes all previous agreements, understanding, proposals, representations and warranties relating to that subject matter.

    4. Those clauses which by their nature would survive the termination of the Agreement shall so survive.

    5. Time wherever referred to in this Agreement shall be of the essence.

    6. The Agreement shall be binding on and shall inure for the benefit of each party's permitted assigns, successors in title, personal representatives, executors and administrators.

  16. Mobile Number Portability (“MNP”)

    1. You may port out from your existing mobile service provider (“Donor Network Operator”), whether prepaid or postpaid service, into Celcom’s network for Xpax and retain your existing mobile number in accordance with this Clause 16.

    2. Celcom will process your application for MNP within:-

      1. one (1) day for individual account; and

      2. five (5) days for corporate account,

        subject  to the approval of the Donor Network Operator.

    3. You may experience service disruption during the porting out activity from the Donor Network Operator to Celcom’s network. If you experience any service disruption, you are advised to call Celcom’s Customer Careline at 019-601 1111 or 1111. Celcom may, upon receipt of port request from you, notify you by way of SMS the progress of your MNP request.

    4. The mobile number that you request for MNP (i) must be within the range of mobile numbers as approved by Malaysian Communication and Multimedia Communication (SKMM) from time to time, subject however to the existing geographic numbering requirements; and (ii) is subject to the approval of the Donor Network Operator.

    5. Mobile numbers which have been suspended, terminated, blacklisted on the defaulters database and/or barred shall not be eligible for MNP.

    6. You hereby agree and warrant to Celcom that you are the registered user of the mobile numbers and/or authorized principals for all the supplementary lines (if any).

    7. You may request to port in to Celcom’s network for and on behalf of a third party provided that you have submitted the following documents:-

      1. an authorization letter signed by the registered third party user;

      2. a photocopy of the third party’s national registration identity card (NRIC) / military ID / passport or a business registration form for corporate account; and

      3. a photocopy of your national registration identity card (NRIC)/military ID/passport.

    8. You shall ensure that the identification of the NRIC or business registration number provided is valid and is not blacklisted from any defaulter database.

    9. You shall be responsible to fully settle all outstanding bills from the Donor Network Operator prior to your request for MNP, failing which your request for MNP may be interrupted.

    10. For individual account, if you are the principal account holder for any supplementary lines, you are only allowed to port in if all supplementary lines under your account are porting in to Celcom.

    11. If you are an existing postpaid user from a Donor Network Operator, you shall ensure that the usage of your existing service does not exceed the credit limit set by your Donor Network Operator.

    12. You may only request for MNP if your existing service with the Donor Network Operator is not under contract. In this instance, you may only proceed with your request for MNP if you terminate the contract with the Donor Network Operator and the cost of such termination shall be borne by you. Celcom shall not be responsible for any and all losses, damages and/or misappropriation arising from the termination of your service with the Donor Network Operator.

    13. All services including value added services (VAS) associated with your SMS/USIM and mobile numbers provided by the Donor Network Operator will be terminated upon successful MNP activation by Celcom.

    14. You shall be solely responsible for all charges incurred by you, including but not limited to any and all outstanding payments and termination fee due and imposed to you by the Donor Network Operator. Service may be interrupted in the event there is non-payment of any outstanding charges owing by you to the Donor Network Operator.

    15. Any remaining credit in your existing prepaid mobile number will be forfeited by the Donor Network Operator upon successful activation of your Service by Celcom.

    16. Celcom may impose a fee up to a maximum of Ringgit Malaysia Twenty Five (RM25.00) for every number that you request for MNP. No refund shall be made for any rejection, cancellation, unsuccessful MNP or withdrawal of the MNP request due to any reason whatsoever.

    17. If the mobile number which you request for MNP is not approved by the Donor Network Operator for any reason whatsoever, upon resolving the matter with the Donor Network Operator, you may continue with your application for MNP, subject to any processing charges which shall be borne by you.

    18. Celcom may, at its sole discretion cancel your request for MNP If:-

      1. Celcom does not receive any instruction from you within thirty (30) days from the date your request for MNP is rejected by the Donor Network Operator; or

      2. Approval from the Donor Network Operator is not obtained within twenty one (21) days from the date of your application.

  17. Tax
    1. In the event the service(s) or product(s) under these Terms and Conditions is taxable pursuant to any applicable laws or regulations including but not limited to the Malaysian Sales and Services Tax (“Applicable Tax”), then Celcom reserves the right to levy the Applicable Tax at the prescribed rate and you agree to pay the amount of the Applicable Tax. The Applicable Tax will be reflected in your postpaid bill or deducted from your prepaid account, where applicable.

This prepaid Xpax mobile service (“Xpax”) and accompanying value added service (collectively referred to as “Service”) is provided to the Customers (hereinafter defined) by Celcom Mobile Sdn Bhd (Company No. 27910-A) (“Celcom”) and is subject to the general terms and condition and these specific terms and conditions for each services provided(“Terms and Conditions”). Customers acknowledge that they have read and understood these Terms and Conditions. Customers’ use of the Service, upon activation, constitutes acceptance of the Terms and Conditions and Customers agree to be bound by the Terms and Conditions. In the event of conflicts or discrepancies between these Terms and Conditions and the terms and conditions in the user guide to the Service (“User Guide”), these Terms and Conditions shall prevail and shall take precedence.

  1. Eligibility
    This Service is applicable to all new and existing customers of twelve (12) years old and above with a valid NRIC or passport (“Customers”) except the Celcom FiRST prepaid customers. Customers are allowed to register the Service for a maximum five (5) Xpax accounts only.
     
  2. Registration
    To register for the Xpax starter pack(s), Customers shall provide an original copy of their National Registration Identification Card (NRIC) or passport to Celcom or its appointed dealer.  Customers’ Xpax account shall be deemed successfully registered upon receipt of an SMS confirmation from Celcom.
     
  3. Activation Bonus
    1. Upon successful activation, 300 MB free high speed internet will be credited into the Customer’s Xpax account (“Activation Bonus”)
    2. Customers will receive an SMS notification to inform that the Activation Bonus has been credited into their account within twenty-four (24) hours from activation. 
    3. The validity period for Activation Bonus shall be as follows(“Activation Bonus Validity Period”):
      1. For RM10 starter pack, validity period shall be five (5) days from date of activation; and
      2. For RM5 starter pack, validity period shall be five (5) days from the date of activation.
    4. Pursuant to item 3(c) above, any unutilized Activation Bonus shall be forfeited upon expiry of the Activation Bonus Validity Period.
    5. The Activation Bonus shall be credited into the Customers’ Xpax account for one (1) time after the activation only.
    6. The Activation Bonus is not transferable to another Celcom’s customers.
    7. Any usage over the Internet shall be deducted from the 300MB data quota of the Activation Bonus and shall be utilised first prior to another data quota package.
    8. Customers may check the remaining balance of their Activation Bonus via USSD *118*1*1*4# from their mobile device.
       
  4. New Activation and Port-In Promotion
    1. Upon successful port-in to Xpax starting from 12th April 2018 until a further period to be notified by Celcom (“Promotion Period”), Mobile Number Portability (“MNP”) customers will receive 1GB high speed internet monthly for twelve (12) months starting from the activation date of the Service.
    2. All promotions under this item 4 shall only be applicable during the Promotion Period only.
       
  5. Plan Rates
    1. The following rates shall apply to the Xpax account:-

    2. Celcom will deduct from the Customers’ Xpax account the value of the Service used by them from time to time at the rates stipulated above and/or as may be imposed at Celcom’s discretion from time to time.
    3. The rates for International Roaming, International Direct Dial (IDD) and Value Added Services (VAS) are as published on Celcom’s official website at www.celcom.com.my 
       
  6. Monthly Freebie Options
    1. Monthly Freebie Option is available for both RM 5 and RM 10 starter packs with the following conditions:-
      1. Maintain an active Xpax prepaid account to enjoy any one(1) of the four Monthly Freebie Options;
      2. Customers can only select one (1) freebie per month;
      3. Customers are not allowed to change their selected freebie of the same month;
      4. Selected freebie will be refreshed on every 1st of the month;
      5. Any changes of freebie for the following month has to be done before 1st of the following month via USSD menu *118*1*1# or Celcom Life App. Changes made in pursuant to this item shall be free of charge.
      6. Usage of the selected freebies must be within the specific application(s) only.
      7. Celcom shall not be liable for any Internet Plan or basic internet data being utilized for any third party content within the selected freebies’ application(s).
      8. P2P and VOIP/video calls on Facebook, WeChat and WhatsApp are excluded from the monthly freebies and shall be charged according to Customer’s usage.
         
  7. Free Basic Internet 
    1. Xpax service comes with free basic internet that is subject to the monthly Fair Usage Policy of 10GB with speed of up to 64kbps (“Free Basic Internet”).
    2. Customers may continue to enjoy Free Basic Internet as long as their account validity is still active.  If the Customers’ account validity is inactive, the Free Basic Internet will be temporarily disconnected until a reload transaction is performed. 
    3. This Free Basic Internet will be refreshed on every 1st of the month.
       
  8. Credit Expiry/Validity
    1. Customers’ prepaid credit or airtime balance can only be used when their Xpax accounts are active. To keep the Xpax account active, Customers are required to perform a credit reload. Any prepaid credit or balance in the Xpax account cannot be exchanged or redeemed for cash.
    2. The preloaded airtime and validity period for each starter pack is as follows:

    3. Any additional reload values shall follow the validity period as stated in the Xpax Reload Specific Terms and Conditions below.
    4. Upon expiry of the validity period, the Customers will have fifty (50) days to perform a reload, failing which their mobile number or account will be automatically terminated without any further notice.
       
  9. Migration
    1. Existing prepaid customers except Celcom FiRST Prepaid customers are allowed to migrate from existing plan to the current Xpax plan by sending “MIG XPAX” to 28882 or via Celcom Life App.  
    2. The migration process is free of charge. Upon migration to the Xpax, Customers are not allowed to migrate back to their original plan.
    3. If Customers migrate from their existing Internet Plan to Xpax, they may carry forward their subscription of the existing Internet Plan to Xpax. Xpax does not include the following bonus and rewards :
      1. Monthly bonus;
      2. Birthday bonus;
      3. Early reload bonus;
      4. Loyalty bonus; and
      5. Surprise Bonus.
    4. If the Customer’s original plan has a validity period of more than thirty (30) days, upon successful migration to Xpax, they shall only get a maximum of thirty (30) days validity period. If the original plan has a validity period of less than thirty (30) days, upon successful migration to Xpax, the validity period for Xpax shall follow the validity period of the original plan.
    5. The 8pax / 15pax / Teman20 / Teman10 or any feature of similar traits shall no longer be valid for the current Xpax.
    6. Existing S.O.X. plan customers will be automatically migrated to Xpax upon reaching 18th birthday at no charge. SMS notification will be sent to the Customers to inform them on the migration.
    7. Existing U.O.X. plan customers will be automatically migrated to Xpax upon reaching 24th birthday at no charge. SMS notification will be sent to the Customers to inform them on the migration.
       
  10. Fair Usage Policy
    Customer’s use of the Service shall be subject to the terms and conditions of Celcom’s Fair Usage Policy which is posted on https://www.celcom.com.my/legal/fair-usage-policy. Celcom reserves the right to manage the allocated bandwidth including but not limited to reducing Customer’s surf speed, suspend or terminate their bandwidth to the internet service in accordance with Celcom’s Fair Usage Policy.

Xpax Reload Specific Terms and Conditions
The reload for Xpax shall be subject to and shall be read together with the general terms and conditions and below specific terms and condition herein. This terms and conditions shall be applicable for additional reload denomination in addition to the Xpax Terms and Conditions above.

  1. Reload and Validity Period
    1. Based on the Customer’s reload denomination and upon every successful reload of RM5 and above, the validity period for the reload shall correspond with Customer’s reload amount. 
    2. Based on the reload denomination, every successful reload will receive a credit validity period based on the following table:

    4. The effective date of the credit validity will be start upon the date of the Customer’s reload. 

The subscription to the Internet Plan (“Internet Plan”) for the Internet Service for Xpax (“Internet Service”) shall be subject to and shall be read together with the general terms and conditions and the specific terms and conditions herein.

  1. Eligibility
    The Internet Plan in the table below shall be applicable to all Celcom’s prepaid customers (“Customers”).
     
  2. Subscription
    1. Customers may subscribe to any of the following Internet Plans:

    2. Customers can subscribe to any of the respective Internet Plan via any  of the following manners     (“Subscription”): 
      1. USSD *118# and follow the instructions therein; or
      2. Celcom Life App; or
      3. Any authorized Celcom dealers.
    3. Upon each successful Subscription to the Internet Plan, Customers shall receive an SMS notification from Celcom notifying Customers of the offerings under respective Internet Plan.
    4. The Weekly Internet Plans will be valid until 11:59PM on the 7th day prior to the successful subscription of the plans. Whereas, the Monthly Internet Plans will be valid until 11:59PM on the 30th day prior to the successful subscription of the plans.
       
  3. Subject to Clause 2 (a) above: 
    1. In the event where the Customer’s account is within the period of fifty (50) days after the expiry of the validity period (“Grace Period”), they shall not be able to use the Internet Service unless they perform a reload transaction.
    2. Customers can also check the validity period or balance of the Internet quota via Celcom Life App or by dialing *118*1*2*2# directly from their mobile phone.
    3. Customers are allowed to have multiple Subscriptions before the expiry of the validity period of the existing Internet Plan (“Existing Internet Plan”). If Customers choose to subscribe to another Internet Plan (“New Internet Plan”) before the expiry of the Existing Internet Plan, the validity period of the multiple Subscriptions shall follow the validity period of the New Internet Plan. Any unused data from the Existing Internet Plan shall be stacked with the New Internet Plan and shall not be forfeited. 
    4. Customers shall receive a notification upon reaching the maximum limit of the volume quota.
    5. Once Customers have fully utilized the Internet quota, they may purchase the following additional Internet quota (“Additional Internet Quota”) by performing direct dial via USSD menu as per instructions provided hereunder:

    6. Once Customers have fully utilized the additional volume purchased, their data usage shall be throttled to the speed of 64KBps.
       
  4. Upon expiry of the validity period of the Internet Plan, the Subscription shall be renewed automatically for all Internet Plans except for Daily Internet Plan. Customers shall be informed via SMS reminder prior to the auto-renewal to notify them on the option to opt out from the Subscription.
     
  5. Pursuant to the above clause, Customers can opt out from the weekly and/or monthly Subscription via USSD menu *118*2*9*1#.
     
  6. If Customer’s account is under the Grace Period, the auto-renewal shall not be applicable for them until they perform a reload transaction.
     
  7. Data Rollover™  (“Data Rollover”)
    1. In the event of multiple Subscriptions, the remaining quota for Existing Internet Plan will be stacked together with the New Internet Plan’s quota with the condition that the Customers have successfully subscribe to the New Internet Plan before the expiry of the Existing Internet Plan.
    2. Internet quota for auto-renewed Internet Plan will also be applicable for this Data Rollover.
    3. Data Rollover feature is available for base Internet quota only. This feature shall not be applicable to other additional data offered in the Internet Plan including but not limited to Video Walla. 
    4. For the Customers who have automatically renewed their Magic Reload and Internet Pack with weekend quota and/or Internet Burung Hantu quota previously, the remaining Internet data shall be stacked. 
    5. The unused free minutes and free SMS shall be forfeited and are not applicable for Data Rollover. 
    6. The validity period under this Data Rollover feature shall be determined by the latest validity period of the latest Subscription of the Internet Plan.
       
  8. Video Walla
    1. Free 15GB for Video Walla will only be exclusively available for Customers with monthly     subscription of Internet Plan worth RM 79. 
    2. In case of multiple Subscriptions, Data Rollover shall not applicable for the remaining unused Internet data for Video Walla.
    3. For further information, Customers may refer to the terms and conditions of Video Walla on     Celcom’s website.
       
  9. Music Walla
    1. Customers who subscribe to any of the Internet Plans listed above will get to enjoy     unlimited access to Music Walla for free subject to the validity period of each Internet Plan.

  10. Unlimited Late Night YouTube
    1. Customers who subscribe to any of the monthly Internet Plans stated herein will get to enjoy an unlimited access to YouTube from 1am – 7am (“Free Access Time”) daily subject to the validity period of the Internet Plan.
    2. Customers’ Internet data quota will be deducted for streaming of videos using other than the YouTube mobile application and/or mobile browser.
       
  11. iflix VIP Access (“Premium Access”)
    1. Customers who subscribe to any of the weekly and/or monthly Internet Plans listed in this terms and conditions will be able to enjoy Premium Access on iflix’s mobile application and browser subject to the validity period of the Internet Plan.

  12. Fair Usage Policy
    1. Your use of the Service shall be subject to the terms and conditions of Celcom’s Fair Usage Policy which is posted on https://www.celcom.com.my/legal/fair-usage-policy . Celcom reserves the right to manage your allocated bandwidth including but not limited to reducing your surf speed, suspend or terminate your bandwidth to the internet service in accordance with Celcom’s Fair Usage Policy.

The subscription of Add-On (“Add-On”) for the Internet and Call Services for all Xpax™ prepaid customers (“Internet Service”) shall be subject to and shall be read together with the general terms and conditions, and Xpax™ Internet Plan specific terms and conditions and the specific terms and conditions herein.

    5. Customers can check the validity period and/ or available Internet quota of the Add-On by dialing *118*1*1*3# for direct dial USSD.
    6. The weekly Internet Plans will be valid until 11.59pm on the 7th day prior to the successful subscription. The monthly Internet Plans will be valid until 11.59pm on the 30th day prior to the successful subscription.
    7. Customers are not required to have an active Internet Plan to enjoy Add-On services. Customers are able to purchase the Add-On on a stand-alone basis.
    8. The auto-renewal for Add-On services is applicable for all weekly and monthly Subscriptions. The Customers shall receive an SMS notification prior to the auto-renewal.
    9. If the Customer’s mobile account has insufficient credit, the auto-renewal shall not be made available.
      1. If the Customer subscribes to two (2) or more Add-On services at the same time (e.g.: Customers subscribed to Weekly and Monthly Video Walla at the same time), all available Add-On services will be auto-renewed and the remaining unused data will be stacked. In case both product will auto-renew at the same date and time but has insufficient balance to renew both, first come first served will apply.
    10. Stop Auto-Renewal
      If the Customers wish to stop the auto-renewal for the Add-On service(s), they can unsubscribe via Xpax App or by dialing the following USSD menu:

  3. Add-On Specific Terms
    1. Late Night Internet:
      1. Available between 1.00AM - 7.00AM only.
      2. The usage of Late Night Internet shall be subject to the terms and conditions of Celcom’s Fair Usage Policy‎.
      3. The Customers shall not use the Service to run programs and/or servers that provide network content or connectivity to any third party not at the location where the connection is installed (including but not limited to FTP, HTTP, newsgroup, proxy, torrents, tethering, P2P and IRC server), upon failing which, Celcom reserves the right to manage Customers allocated bandwidth including but not limited to reducing Customers surf speed, suspend or terminate Customers bandwidth to the internet service.
    2. Video Walla:
      1. Customers will enjoy access to unlimited data for video streaming only at high speed when they access the following partner platforms mobile application:
        1. Iflix
        2. Tonton
        3. Youtube
        4. Astro on the Go
        5. Dim Sum
        6. Daily Motion
        7. Mox Digital
           
      2. The IP whitelist serves traffic for all partners’ video streaming services, including but not limited to video functions within the app that consumes data.
      3. If Customers have an active mobile internet plan:-
        1. The internet plan quota will not be used when Customers stream video from the above listed video streaming’s platforms.
        2. The video pack will be utilized first while video streaming (for selected partners mentioned above only).
        3. When Customers perform multiple subscription by purchasing more than one video pack, the data should be accumulated and shall not be forfeited.
        4. Video pack will be utilized first versus weekend/weekday for prepaid.
        5. Video pack will be utilized first versus MI for postpaid (Non-legacy).
        6. Video pack will be utilized first versus basic internet and late night internet (1am – 7am) for postpaid (Legacy with Mobile Internet plan).
      4. If Customers do not have an active mobile internet plan, the video pack service will be suspended until they have reloaded their mobile account. Customers will have to re-subscribe to the service again in order to continue streaming video.
    3. Facebook Walla
      1. Customers will enjoy access to Facebook, Twitter, WhatsApp, and WeChat sites at high speed when they access from their Facebook, Twitter, WhatsApp, and WeChat mobile application or through mobile browsers (“Allowed Social Media Sites”).
      2. If Customers have an active internet plan:-
        1. Customers’ internet plan quota will not be used when Customers access the Allowed Social Media Sites.
        2. Any data usages for the Allowed Social Media Sites will be deducted from the Facebook Walla’s data quota first.
        3. Any data usages outside of the Allowed Social Media Sites will be deducted from Customers’ active internet plan quota.
      3. If Customers do not have an active internet plan:-
        1. They will enjoy access to the Allowed Social Media Sites at high speed and the usage will be deducted from the Facebook Walla’s quota.
        2. Any data usages outside of the Allowed Social Media Sites will be throttled at 64kbps.
      4. Facebook Walla’s quota will not be used when Customers access the Allowed Social Media Sites through the Opera Mini and/or UCMini browsers.
    4. Instagram Walla
      1. Customers will enjoy access to Instagram, Twitter, WhatsApp, and WeChat sites at high speed when they access from their Instagram, Twitter, WhatsApp, and WeChat mobile application or through mobile browsers (“Social Media Sites”).
      2. If Customers have an active internet plan:-
        1. Customers’ internet plan quota will not be used when Customers access the Social Media Sites.
        2. Any data usages for the Social Media Sites will be deducted from the Instagram Walla’s data quota first.
        3. Any data usages outside of the Social Media Sites will be deducted from Customers’ active internet plan quota.
      3. If Customers do not have an active internet plan:-
        1. They will enjoy access to the Social Media Sites at high speed and the usage will be deducted from the Instagram Walla’s quota.
        2. Any data usages outside of the Allowed Social Media Sites will be throttled at 64kbps.
      4. Instagram Walla’s quota will not be used when Customers access the Social Media Sites through the Opera Mini and/or UCMini browsers.
    5. Basic Internet
      1. Customers will enjoy unlimited Basic Internet with speed of up to 64kbps (“Basic Internet”).
    6. Music Walla
      1. Customers will enjoy access to unlimited data for music streaming when they access to Celcom’s partner platforms mobile application which details are as posted on Celcom’s website;
      2. The IP whitelist serves traffic for all partners’ music streaming services, including but not limited to video functions within the app that consume data.
      3. If Customers have an active mobile Internet plan;
        1. Internet plan quota will not be used when Customers stream music from the music streaming partner platforms.  
      4. Multiple subscriptions are not allowed as Music Walla comes with an unlimited quota package. If Customers tries to subscribe to a music pack when they already have an active music pack subscription, they will be notified of their current active status and highlight the upcoming expiry time/date.
    7. Voice Call (Celcom Network only)
      1. Customers will enjoy unlimited calls to Celcom’s network only for the Daily and Weekly Plan.
      2. The service shall be available for 24 hours or seven (7) days from the time of subscription.
      3. For calls to any other networks, pay per use (“PPU”) rate based on Customers’ plan will apply.
      4. The Unlimited Calls apply to Celcom Network only (i.e. within Malaysia network) excluding video calls, calls to toll-free numbers or numbers with special charges (i.e. 1-300/1-800/600, 121, TM100, 1MOCC, IDD calls to Singapore & IDD/border calls to Brunei).
      5. Standard person-to-person calls or texts and not for any commercial and/or non-personal usage.
      6. Non-multiple simultaneous calling, conference calling, re-supply, call center usage, telemarketing, bulk messaging, application-to-person communication, continuously call forwarding, auto-dialing, machine-to-machine communication (including by using Customers’ SIM card in any other devices), Cellular Trunking Units (CTUs), or any other activity Celcom considered to be a non-standard usage.
         
  4. Subject to Clause 2(a),(b) above
    1. Add-On which come with quota allocation is subject to the following:
      1. In the event of auto-renewal, any remaining unused Internet quota will be carried forward at the end of the validity period. The quota from the expired Add-On service shall be stacked with the new Add-On.
      2. Upon full utilization of the purchased Add-On quota, any further Internet usages will be deducted from Customers base internet allocation (if any), followed by throttled speed at 64kbps.
    2. Add-On which come with unlimited quota allocation including Video Walla, Basic Internet and Voice Call is subject to Celcom’s Fair Usage Policy and the following:
      1. If Customers use of unlimited services is deemed to have a negative impact on Celcom’s and everyone’s ability to enjoy the services, Celcom may, at its option, terminate or suspend the service, or change their plan to the one without unlimited usage components.
    3. Upon expiry of the Internet Add-On subscription, data charges will be deducted from the remaining quota of Customers existing internet plan (if any), otherwise:
      1. For Xpax customers: Customers will enjoy free basic internet throttled at 64kbps;
      2. For other Xpax prepaid plans: prevailing pay per use charges will apply.
    4. Customers will not be able to use the Service if their account is in Grace Period. For clarity, “Grace Period” shall mean fifty (50) days from the expiry of the validity period of their account. Customers may only continue to use the Internet Service once Customers perform a reload during the Grace Period.
    5. Customers are allowed to subscribe to any other similar Add-On before the expiry of the validity period of the existing Add-On subscribed by Customers (“Existing Add-On”) except for Music Walla, Basic Internet and Voice Calls. If Customers choose to subscribe to another Add-On (“New Add-On”) before the expiry of the validity period of Existing Add-On, the validity period of the New Add-On shall follow the latest validity period. Any remaining Internet quota from the existing Add-On shall be carried forward and be stacked into the new Add-On.
    6. Celcom shall notify the Customers upon seventy percent (70%) and (100%) utilization of the Internet Quota.
    7. Once Customers have fully utilized the volume quota, Customers’ data usage shall be throttled to a maximum speed of 64Kbps.

Introduction
This Promotion is held by Celcom Mobile Sdn Bhd (Company No. 27910-A) (“Celcom”). By participating in the Promotion, the Customer (as herein defined) hereby agrees to be bound by these terms and conditions which shall form an integral part and to be read together with terms and conditions of Customer Registration Form (CRF) and/or terms and conditions of the respective mobile/content service(s) offered and relevant to the Customer in respect of this Promotion.
In the event of a conflict or inconsistency between these terms and conditions and CRF and/or terms and conditions of the respective mobile/content service(s), such inconsistency shall be resolved by giving precedence in the following order (i) these terms and conditions (ii) terms and conditions of CRF and/or the respective mobile/content service(s).
 
Duration of Promotion
This Promotion shall commence from 8th February 2018 until further notified by Celcom (“Promotion Period”). Any extension thereof shall be at the sole discretion of Celcom.

      For further details on the manner of subscription and opt-out option for each specific MI Plan or Add-On Plan, Customers may refer to the FAQ as per available on the Celcom’s website.
       
  4. The Customers will receive an SMS notifying the Customers of the successful subscription, upon which Customers can start to enjoy the MI Plan or Add-On Plan.
     
  5. The Customers can check the status of the remaining validity period and quota balance for each MI Plan or Add-On Plan via USSD *118*1*1*3# or via Xpax™ App. 
  6. Data Rollover feature is only applicable for base quota for the purpose of this Promotion.
     
  7. The Customers must maintain an active prepaid account and have sufficient prepaid credit to successfully subscribe to the MI Plan or Add-On Plan. Customers with insufficient credit shall not be able to renew the Subscription until they reload their mobile account.
     
  8. The bonus data for both MI Plan and Add-On Plan shall be utilised first before the base quota quota.
     
  9. The bonus data for both MI Plan and Add-On Plan will be expired at 11:59 PM (Local Time) on the 2nd day (Weekly Plans) or 3rd day (Monthly Plans) respectively.

Reload For Xpax™

The reload for Xpax shall be subject to and shall be read together with the general terms and conditions and below specific terms and condition herein. This terms and conditions shall be applicable for additional reload denomination in addition to the Xpax Terms and Conditions above.

  1. Reload and Validity Period
    1. Based on the Customer’s reload denomination and upon every successful reload of RM5 and above, the validity period for the reload shall correspond with Customer’s reload amount. 
    2. Based on the reload denomination, every successful reload will receive a credit validity period based on the following table:

  7. The Customers may increase the internet speed by re-purchasing the 1 Day Social Roam Pass by following the methods in Clause 1. All balance from the earlier subscription will be replaced with the new subscription.
  8. In the event the Customers have subscribed to any internet package prior to 1 Day Social Roam Pass, the balance from earlier subscription will be forfeited and replace with new subscription.
  9. The Customers can check the status of the Validity Period or Volume Quota by sending MAX STATUS to 28882 or dial *118# and selecting “Check Balance”.
  10. For avoidance of doubt, the Promotion shall only be applicable if the Customers is connected to the Operator listed in Clause 3 above. In the event that the Customers connect to any other operators, the charges imposed shall be based on relevant charges based on the roaming country’s rates, Celcom’s pay per use rates, Celcom’s prevailing rates and/or any other charges imposed by Celcom from time to time.

Terms and conditions 1 Day Internet Pass for Prepaid (“Promotion”)

Introduction
This Promotion is held by Celcom Mobile Sdn Bhd (Company No. 27910-A) (“Celcom”). By participating in the Promotion, the Customers (as herein defined) hereby agrees to be bound by these terms and conditions which shall form an integral part and to be read together with terms and conditions of Customers Registration Form (CRF) and/or terms and conditions of the respective mobile/content service(s) offered and relevant to the Customers in respect of this Promotion.

  3. Customers will have access to the Internet once Customers are connected to the preferred network operators at the countries travelled upon subscription;
  4. Customers shall be charged RM38 per day (“Charge”) upon using Internet services at selected countries through preferred network operators. For the avoidance of doubt, Customer who fails to connect to preferred networks will not get access to the Internet and 1-Day Internet Pass will not be activated. Customers may view the list of countries, preferred network operators and available Internet quota at www.xpax.com.my.
  5. Activation of this 1-Day Internet Pass allows Customers to enjoy high-speed Internet quota. Upon full utilization of the high-speed Internet quota for the day, Internet usage will be throttled to 64kpbs. For the avoidance of doubt, the high-speed Internet quota will be different from one country to another.
  6. Upon full utilization of the existing Internet quota, Customers may purchase Internet Quota Add-On by dialing *118#. Internet Quota Add-On allows Customers to enjoy additional Internet quota. Purchase of Internet Quota Add-On is subject to the following terms and conditions:
    1. Customer may purchase 100MB additional Internet quota for RM10.
    2. For the avoidance of doubt, Internet Quota Add-On is not available for Customers who do not have active 1-Day Internet Pass. Internet Quota Add-On is not a stand-alone promotion.
    3. Any balance of unutilized Internet quota will not be carried forward and to be forfeited by end of day upon auto-subscription of the 1-Day Internet Pass.
    4. Customers may purchase more than one Internet Quota Add-On in one day.
  7. Upon expiry 1-Day Internet Pass, customers may increase the internet speed and/or renew the pass by re-purchasing 1-Day Internet Pass via *118#. For the avoidance of doubt, the customers may enjoy the active Pass until 11.59pm (Malaysian time);

Promotion Mechanics

  1. This Promotion allows the Customers to use Internet data while roaming outside of Malaysia subject to this Terms and Conditions. The Customers shall receive a welcoming message about the Promotion.
  2. This Promotion involves a 1-Day Basic Internet Pass (“Pass”) and can be activated through any of the following manners (“Activation”):
    1. USSD menu *118# and select 1-Day Basic Internet Pass; 
  3. The Customers need to activate any available roaming pass first to avoid being charged pay-per-use (“PPU”). Customers can then switch on data roaming on their mobile and will be automatically latched on to the preferred network operator (“Operators”) as specified hereinafter and perform the Activation thereafter.
  4. Customers who latch to the Non-Preferred Operators will not be able to use the Internet as the data will be blocked.
  5. Customers can activate the Pass while they are still in Malaysia or upon their arrival abroad. The charge shall be applicable from the time of the successful Activation.
  6. Customers shall receive an SMS notification and be charged RM1.00 (“Charge”) upon each successful Activation at the selected countries through the Operators. For the avoidance of doubt, Customers who fail to connect to the preferred networks will not get access to the Internet and the Pass will not be activated.
  7. Customers shall enjoy the basic Internet service once they are connected to the Operators at the selected countries as specified below:

  9. Upon full utilisation of the 30 MB Internet quota, the data shall be blocked and Customers can no longer enjoy the basic Internet. The Customers have to reactivate the Pass or any other roaming pass available in the USSD menu in order to continue enjoying the basic Internet. The applicable charge shall be based on the particular pass activated by the Customers.
  10. For this Promotion purpose, the Pass will not be automatically renewed. Customers need to reactivate it on the following day to enjoy the Promotion upon expiry.
  11. Activation of the Pass shall allow the Customers to enjoy basic Internet until 11.59pm (Malaysian Time).
  12. In any circumstances when the Operators have no coverage and device steer to the Non-Preferred Operators, Internet usage will be automatically blocked, except for sending SMS or calls. Pursuant to this, the Customers will be charged PPU.
  13. The fair usage policy of the Internet usage for both Celcom and the Operators shall apply.
  14. Celcom reserves the right to terminate the Promotion without giving any prior notice to the Customers.
  15. Celcom does not guarantee the speed or coverage availability during roaming.

  14. No delay or indulgence by Celcom in enforcing any terms or conditions herein shall constitute a waiver by Celcom of the Customers’ breach of these terms and conditions.

Introduction

This Promotion is held by Celcom Mobile Sdn Bhd (Company No. 27910-A) (“Celcom”). By participating in the Promotion, the Customers (as herein defined) hereby agrees to be bound by these terms and conditions (“Terms and Conditions”) which shall form an integral part and to be read together with terms and conditions of the Fair Usage Policy and/or Customers Registration Form (“CRF”) and/or terms and conditions of the respective mobile/content service(s) offered and relevant to the Customers in respect of this Promotion. 
In the event of a conflict or inconsistency between these Terms and Conditions and/or terms and conditions of the Fair Usage Policy and/or terms and conditions of the CRF and/or terms and conditions of the respective mobile/content service(s), such inconsistency shall be resolved by giving precedence in the following order (i) these Terms and Conditions (ii) terms and conditions of the Fair Usage Policy and/or the CRF and/or (iii) the respective mobile/content service(s). 

Duration of Promotion
This Promotion shall commence from 17th August 2017 shall continue to be valid until further notice by Celcom (“Promotion Period”).  Any extension thereof shall be at the sole discretion of Celcom. 

Eligibility

This Promotion shall be available to all Celcom’s prepaid customers (“Customers”). 
Promotion Mechanics

  1. This Promotion allows the Customers to use the Internet data while roaming outside Malaysia subject to this Terms and Conditions.
     
  2. Customers will receive a notification on the Promotion and the 1-Day Internet Pass RM4.99 (“Internet Pass”) will be activated upon activation by the Customers via USSD by dialing *118#.
     
  3.  Customers will have access to the Internet once Customers are connected to the preferred network operators at the countries travelled upon subscription. Customers may view the list of countries and preferred network operators at Xpax’s website.
     
  4. Customers shall be charged RM4.99 per day (“Charge”) upon using Internet services at the selected countries through preferred network operators. For the avoidance of doubt, Customers who fail to connect to preferred networks will not get access to the Internet and the Internet Pass will not be activated. 
     
  5. Customers can enjoy the active Internet Pass until 11.59 pm (Malaysian time) regardless of the activation time.
     
  6. Activation of the Internet Pass allows Customers to enjoy high-speed internet quota. Upon full utilization of the high-speed Internet quota for the day, Internet usage will be throttled to 64kbps.
     
  7. Upon full utilization of the existing Internet quota, Customers may purchase an additional internet quota (“Internet Quota Add-On”) by dialing USSD *118#. Internet Quota Add-On allows Customers to enjoy additional Internet quota.
     
  8. Purchase of Internet Quota Add-On is subject to the following terms and conditions:
    1. Customers may purchase 100MB additional Internet quota for RM10.
    2. For the avoidance of doubt, Customers must have an active Internet Pass to purchase the Internet Quota Add-On.  The Internet Quota Add-On is not a stand-alone promotion. 
    3. Any balance of unutilized Add-On will not be carried forward and to be forfeited by end of the day upon expiry of the internet pass
    4. Customers may purchase more than one Add-On in one day. 
       
  9. Upon expiry of the Internet Pass, the Customers may increase the internet speed and renew the     pass by re-purchasing the Internet Pass via USSD *118# and follow instructions therein. Auto-    renewal is not applicable to the Customers.
     
  10. The terms and conditions of the Internet usage for both Celcom and the preferred network     operators shall apply.
     
  11. Celcom reserves the right to terminate this Promotion without giving any prior notice to the     Customers.
     
  12. Celcom does not guarantee the speed or coverage availability during roaming.

General Terms and Conditions

  1. Celcom reserves the sole and absolute right to withdraw, amend, omit and/or vary any part or the whole of the Terms and Conditions of this Promotion without prior notice to the Customers herein stated and the Customers shall be bound to observe, perform and comply with the Terms and Conditions herein and any amendments thereof. 
     
  2. Celcom’s decisions in any matter in relation to the Promotion shall be final and conclusive. Any request for appeal and review shall not be entertained.
     
  3. Celcom shall not be liable for any claim by the Customers or any third-party or loses of any nature, including but not limited to, loss of profits, punitive, indirect, special, incidental or consequential damages or for other damages and any related claims of any nature, including direct, indirect, third party, consequential or other damages resulting from or in connection with this Promotion. 
     
  4. Celcom disclaims any liability for loss or damage to property or any personal injury or loss of life resulting from or in connection with this Promotion. 
     
  5. The Customers acknowledge and agree that Celcom reserves the rights to disqualify any participation if the Customers are in breach of its obligations or any Terms and Conditions of this Promotion. Notwithstanding the above, Celcom reserves the right to reject any participation or the Customers at its sole and absolute discretion without assigning any reasons whatsoever. 
     
  6. Celcom does not take any responsibility in the event Customers are prevented from participating in the Promotion, as a result of certain technical restrictions or other limitations or force majeure which shall include but not limited to regulatory and/or government directive, act of God etc. 
     
  7. All photographs, personal information and names submitted in the Promotion, service marks, trade names, trademarks are the property of Celcom.  
     
  8. Celcom reserves the right, at its absolute discretion, to use the names, photographs, voice or video recordings and entries of the Customers for publicity, advertising, trade or promotional purposes in any media, without first obtaining any consent nor making any payment whatsoever to the Customers. 
     
  9. Except as expressly mentioned herein, Celcom shall not be responsible for any expenses and cost including out-of-pocket expenses related to or as a consequence of participating in this Promotion. 
     
  10. All prizes offered under this Promotion (if any) are not transferable for cash or in kind and shall be subject to availability of stock. Celcom reserves the right to substitute and replace the prize offered with another prize of equal value or higher value as Celcom deems fit. 
     
  11. Celcom disclaims any warranties or liabilities for the merchantability and fitness of the prize (if any) under this Promotion. The warranties applicable for the prize are subject to the terms and conditions provided by the manufacturer or supplier of the prize. 
     
  12. In the event any of the provision in these terms and conditions is invalid, illegal and unenforceable under any applicable law or by any reasons whatsoever, the legality and enforceability of the remaining provisions shall not be affected.

Usage

  13. Once you have fully utilized the Volume Quota, your data usage shall be throttled to a maximum speed of 64Kbps.
  14. Celcom will be excluded on any claim for any device (or application installed thereon) on any third party lawsuit or proceeding brought against Celcom.

Things we may do to the Service(s)
We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar, suspend, restrict the Service for such time as we see fit or terminate, discontinue or disconnect the Service if your usage:

  1. Shows excessive usage or placing unusual burdens on our Network;
  2. Is for unlawful activities or for suspected fraudulent activities;
  3. Unusual calling patterns inconsistent with normal, individual plan use, for example, regular calls of short duration or calls to multiple numbers in a short period of time;
  4. Using our Service(s), minutes, SMS' or data (SIM boxing, bulk SMS service or aggregate minutes) wholesale on our Network
  5. Is for commercial/non-personal purposes.

The subscription to the Internet Plan (“Xtra Pass”) for the Internet Service for Xpax (“Internet Service”) shall be subject to and shall be read together with the general terms and conditions and the specific terms and conditions herein.

    3. Upon each successful Subscription to the Xtra Pass, Customers shall receive an SMS notification from Celcom notifying Customers of the offerings.
  3. Subject to Clause 2 (a) above:
    1. In the event where the Customer’s account is within the period of fifty (50) days after the expiry of the validity period (“Grace Period”), they shall not be able to use the Internet Service unless they perform a reload transaction.
    2. Customers can also check the validity period or balance of the Internet quota via Celcom Life app or USSD menu by dialing *141*3*5# or SMS text MAX STATUS to 28882 directly from their mobile phone
    3. Customers are allowed to have multiple Subscriptions before the expiry of the validity period of the existing Xtra Pass (“Existing Xtra Pass”). If Customers choose to subscribe to another Xtra Pass (“New Xtra Pass”) before the expiry of the Existing Xtra Pass, the validity period of the multiple Subscriptions shall follow the validity period of the New Xtra Pass. Any unused data from the Existing Xtra Pass shall be stacked with the New Xtra Pass and shall not be forfeited.
    4. Customers shall receive a notification upon reaching the maximum limit of the volume quota.
    5. Once Customers have fully utilized the Internet quota, their data usage shall be throttled to the speed of 64KBps.
  4. Upon expiry of the validity period of the Xtra Pass, the Subscription shall be renewed automatically for all except for Daily Xtra Pass. Customers shall be informed via SMS reminder prior to the auto-renewal to notify them on the option to opt out from the Subscription.
  5. Pursuant to the above clause, Customers can opt out from the weekly and/or monthly Subscription via Celcom Life app or USSD menu by dialing *141*3*6#.
  6. If Customer’s account is under the Grace Period, the auto-renewal shall not be applicable for them until they perform a reload transaction.
  7. Data Rollover™
    1. In the event of multiple Subscriptions, the remaining quota for Existing Xtra Pass will be stacked together with the New Xtra Pass’s quota with the condition that the Customers have successfully subscribe to the New Xtra Pass before the expiry of the Existing Xtra Pass.
    2. Data Rollover™ feature is available for base Internet quota only. This feature shall not be applicable to other additional data offered in the Xtra Pass. 
    3. The unused IDD Credit shall be forfeited and are not applicable for Data Rollover™.
    4. The validity period under this Data Rollover™ feature shall be determined by the latest validity period of the latest Subscription of the Xtra Pass.
  8. Late night Video Walla™
    1. Customers who subscribe to weekly and monthly Xtra Pass will get to enjoy a 1GB or 2GB data quota to access late night Video Walla™ from 1am – 7am daily subject to the validity period of the Xtra Pass.
    2. Customers’ base Internet data quota will be deducted if customer fully utilize the 1GB or 2GB quota given even tough customer streaming within the duration of late night Video Walla™ time.
    3. Customer will be given free access to channel but subject to free content provided only.

  9. Fair Usage Policy
    Your use of the Service shall be subject to the terms and conditions of Celcom’s Fair Usage Policy which is posted on https://www.celcom.com.my/legal/fair-usage-policy . Celcom reserves the right to manage your allocated bandwidth including but not limited to reducing your surf speed, suspend or terminate your bandwidth to the internet service in accordance with Celcom’s Fair Usage Policy.

Video Walla Add On
The subscription for Add On (“Add On”) for the Internet and Call Services for all Celcom customers (“Internet Service”) shall be subject to and shall be read together with the general terms and conditions and specific terms and conditions of Internet Plan herein.

Video Walla offering combines premium video services and allocated data for video streaming to all Celcom subscribers in one pack. Celcom subscribers will be given the freedom of choice to stream their preffered movies, TV shows and any videos at anytime, anywhere with Malaysia’s widest and fastest mobile network.

Eligibility

  1. The Add On in the table below shall be applicable to all Celcom customers.
  2. To enjoy this service, prepaid customers must be on an active SIM.
  3. The following postpaid plans are eligible for this add on:
    1. Retail & Enterprise Postpaid Plans with Data including data only / broadband plans – applicable for both RTP & Legacy Postpaid.

    3. If you have an active mobile Internet plan;
      1. Your Internet plan quota will not be used when you stream music from the music streaming partner platforms.
    4. You are not required to have an active Internet plan to enjoy Add-On services. You are able to purchase the Add On on stand alone basis.

Quota allocation

  1. Add Ons which come with unlimited quota allocation is subject to the following:
    1. If your use of our unlimited services is deemed to have a negative impact on Celcom’s and everyone’s ability to enjoy our services, Celcom may, at its option, terminate or suspend your service, or change your plan to one with no unlimited usage components.
  2. Upon expiry or termination of the Add On subscription, data charges will be deducted from the remaining quota of your existing Internet plan (if any), otherwise;
    1. For Xpax customers: you will enjoy free basic internet throttled at 64kbps
    2. For other Xpax prepaid plans: prevailing pay per use charges will apply
    3. For postpaid customers, data quota of plan will be exercised.
  3. You will not be able to use the Add On services if your account is in Grace Period. For clarity, “Grace Period” shall mean fifty (50) days from the expiry of the validity period of your account. You may only continue to use the Internet Service once you perform a reload during the Grace Period.
  4. You are allowed to subscribe to any other Add On services offered by Celcom before the expiry of the Validity Period of the existing Add On subscribed by you (“Existing Add On”). If you choose to subscribe to the same Add On (“Music Pack”) before the expiry of the validity period of your Existing Add On, the validity period of the new Add On shall supersede the validity period of your Existing Add On and any existing volume quota in your existing Internet Plan shall be forfeited.
  5. Multiple subscription is not allowed. If user tries to subscribe to a music pack when they already have an active music pack subscription, they will be notified of their current active status and highlight the upcoming expiry time/date.
  6. The add-on packs are set on auto-renew as default but prepaid customers will receive an auto renewal SMS reminder 1-day before the renewal of add-on is charged. This applies both for weekly and monthly options.

The Xpax Youth benefits are valid for monthly Xpax™ Internet Plan subscriptions made during 12th April 2018 until further notice.

Eligibility
The Xpax Youth shall be applicable to all youth residing in Malaysia age 12-25 (by the time this Terms & Conditions is read) with National Registration Identity Card for Malaysians (MyKad) that are on the new Xpax™ Pack prepaid. Celcom does not take any responsibility in the event Customer is prevented from subscribing in the Internet Plan , as a result of certain technical restrictions or other limitations specific or force majeure which including but not limited to regulatory and/or government directive, act of God etc.
  7. All photographs, personal information and names submitted in the Internet Plan, service marks, trade names, trademarks are the property of Celcom.
  8. Celcom reserves the right, at its absolute discretion, to use the names, photographs, voice or video recordings and entries of the Customer for publicity, advertising, trade or Internet Plan purposes in any media, without first obtaining any consent nor making any payment whatsoever to the Customer.

    2. USSD.

    For further details on the manner of subscription and opt-out option for each specific Daily Add-On Plan, Customers may refer to the FAQ as per available on the Celcom’s website.

  4. The Customers will receive an SMS notifying the Customers of the successful subscription, upon which Customers can start to enjoy the Daily Add-On Plan.

  5. The Customers can check the status of the remaining validity period and quota balance for Daily Add-On Plan via USSD *118*1*1*3# or via Celcom Life App. 

  6. The Customers must maintain an active prepaid account and have sufficient prepaid credit to successfully subscribe to the Daily Add-On Plan. Customers with insufficient credit shall not be able to subscribe until they reload their mobile account.

  7. The data for Daily Add-Ons Plan will be valid for 24 hours upon successful subscription.

  8. The terms and conditions for this Promotion shall be read together with the general terms and conditions for Xpax Add-On Plans.

Celcom shall not be liable for any claim by the Customer or third-party claims or loses of any nature, including but not limited to, loss of profits, punitive, indirect, special, incidental, or consequential damages or for other damages and any related claims of any nature, including direct, indirect, third party, consequential or other damages resulting from or in connection with this Campaign. 
  4. Celcom disclaims any liability for loss or damage to property or any personal injury or loss of life resulting from or in connection with this Campaign. 
  5. The Customer acknowledges and agrees that Celcom reserves the rights to disqualify any participation if the Customer is in breach of its obligations or any terms and conditions of this Campaign. Notwithstanding the above, Celcom reserves the right to reject any participation or the Customer at its sole and absolute discretion without assigning any reasons whatsoever.
  6. Celcom does not take any responsibility in the event Customer is prevented from participating in the Campaign, as a result of certain technical restrictions or other limitations specific or force majeure which including but not limited to regulatory and/or government directive, act of God etc. 
  7. All photographs, personal information and names submitted in the Campaign, service marks, trade names, trademarks are the property of Celcom. 
  8. Celcom reserves the right, at its absolute discretion, to use the names, photographs, voice or video recordings and entries of the Customer for publicity, advertising, trade or Campaign purposes in any media, without first obtaining any consent nor making any payment whatsoever to the Customer.
  9. Except as expressly mentioned herein, Celcom shall not be responsible for any expenses and cost including out-of-pocket expenses related to or as a consequence of participating in this Campaign.
  10. All rewards offered under this Campaign are not transferable for cash or in kind and shall be subject to availability of stock. Celcom reserves the right to substitute and replace the reward offered with another reward of equal value or higher value as Celcom deems fit.
  11. In the event any of the provision in these terms and conditions is invalid, illegal and unenforceable under any applicable law or by any reasons whatsoever, the legality and enforceability of the remaining provisions shall not be affected.
  12. No delay or indulgence by Celcom in enforcing any terms or conditions herein shall constitute waiver by Celcom of the Customer’s breach of these terms and conditions. 

Switch Now

  1. These terms and conditions shall apply if you are porting into Celcom's network from your existing mobile service provider ("Donor Network Operator"). These terms and conditions shall be read together with the terms & conditions of Celcom Customer Registration Form and the terms and conditions of the relevant service you subscribe to.
  2. Celcom reserves the rights to change, amend and alter any part of these terms and conditions without prior notice to you and you hereby agree to be bound by such changes, amendments and alterations.
  3. Celcom will process your application for mobile number porting between;
    1. Two (2) days for individual account.
  4. You may experience service disruption with your existing mobile number during the porting in activity from the Donor Network Operator to Celcom's network. If you experience any service disruption, you are advised to call Celcom's Customer Care line at 1300 111000 or 1111. 1111 is only valid for Celcom number. For other mobile service provider number ("Donor Network Operator"), customer may reach Celcom’s Contact Centre via 019 6011111.
  5. Celcom may, upon receipt of port request from you, notify you by way of SMS the progress of your port request.
  6. The mobile number that you request for porting
    1. must be within the range of mobile numbers as approved by Malaysian Communication and Multimedia Communication (SKMM) from time to time, subject however to the existing geographic numbering requirements; and
    2. is subject to the approval of the Donor Network Operator.
  7. Mobile Number which have been suspended, terminated, blacklisted on the defaulters database and/or barred shall not be eligible for porting;
  8. You hereby agree and undertake to Celcom that you are the registered user of the mobile numbers and/or authorised principals for all the supplementary lines (if any);
  9. You may request to port-in to Celcom's Network for and on behalf of a third party provided you have submitted the following documents:
    1. An authorisation letter signed by the registered user of the third party mobile numbers;
    2. A photocopy of the third party national registration identity card / military ID / passport ; and
    3. A photocopy of your national registration identity card / military ID / passport
  10. You shall ensure the identification of national registration identity card or Business Registration number provided, it is valid and is not blacklisted from the defaulter database.
  11. You shall be responsible to fully settle all outstanding bills from Donor Network Operator prior to your request for porting, failing which your request for MNP may be interrupted.
  12. For individual account, if you are the principal account holder, where you are solely responsible for all supplementary lines subscribed under your account, you are only allowed to port-in if all supplementary lines under your account are porting to Celcom.
    1. You hereby acknowledge and accept that:
      1. The Mobile Number that you request for porting must be in the range of Mobile Number as approved by SKMM from time to time;
      2. Mobile Number porting is subject to existing geographic numbering requirements;
      3. Mobile Number which have been suspended, terminated, blacklisted on the defaulters database and/or barred shall not be eligible for porting; and
      4. Celcom may, upon receipt of a port request from you, notify you by way of SMS the progress of your port request.
    2. You are allowed to port from prepaid Services to postpaid Services. However, you agree and accept that all porting requests are subject to the respective Celcom terms and conditions for new registration.
  13. For corporate account, you shall be responsible to identify the supplementary Mobile Number (e.g. voice, fax and data) that you wish to port along with your primary Mobile Number and to provide all information necessary to satisfy Celcom to proceed with the porting request.
  14. You shall ensure that the usage of your existing service does not exceed the credit limit set by your Donor Network Operator.
  15. You may only request for MNP if your existing service with the Donor Network Operator is not under contract. In this instance, you may only proceed with your request for MNP if you terminate the contract with the Donor Network Operator and the cost of such termination shall be borne by you. Celcom shall not be responsible and/or liable for any and all losses, damages and/or misappropriation arising from this termination of your services with Donor Operator and you shall indemnify Celcom from any liability arising thereof.
  16. All services including value added services (VAS) associated with your SIM/USIM and mobile numbers provided by the Donor Network Operator will be terminated upon successful MNP activation by Celcom;
  17. You shall be solely responsible for all charges incurred by you, including but not limited to any and all outstanding payments and penalties charges due and imposed to you be the Donor Network Operator. Service may be interrupted in the event there is non-payment of any outstanding charges owing by you to the Donor Network Operator.
  18. For prepaid service, any remaining credit in your existing prepaid mobile number will forfeited by the Donor Network Operator upon successful activation of your Service by Celcom;
  19. You are allowed to port from prepaid Services to postpaid Services. However, you agree and accept that all porting requests are subject to the respective Celcom terms and conditions for new registration.
  20. If the mobile number which you request for porting is not approved by Donor Network Operator for any reason whatsoever, upon resolving the matter with the Donor Network Operator, you may continue with your application for MNP, subject to any processing charges which shall be borne by you.
  21. A new temporary prepaid SIM Card with your ported in number will be given immediately upon submission of MNP request to Celcom. The SIM Card will contains airtime value of RM3 and 200MB data and is valid for 5 days only. No reload is allowed for the temporary number and it will be terminated once the MNP process is completed, approved or rejected by Celcom, or after a period of 5 days subject to whichever comes first. All airtime and data balance will be forfeited upon MNP request process approval and completion.
  22. If:
    1. Celcom does not receive any instruction from you within thirty (30) days from the date your request for MNP is rejected by the Donor Network Operator; or
    2. Approval from the Donor Network Operator is not obtained within twenty one (21) days from the date of your application;

Celcom may, at its sole discretion cancel your request for MNP.
