TERMS & CONDITIONS FOR CELCOM PHONES PROMOTION (“Promotion”)
 

This Promotion is organized and held by Celcom Mobile Sdn Bhd (27910-A) (“Celcom”).By participating in this Promotion, customer hereby taken to have read and be bound by these terms & conditions which shall form an integral part and to be read together with terms and conditions of Celcom’s service offered and addendum to the voice or data plans relevant to the customer in respect to this Promotion.

In the event of a conflict or inconsistency between these terms and conditions and terms and conditions of Celcom’s service, such inconsistency shall be resolved by giving precedence in the following decreasing order (i) addendum to the voice or data plans to Celcom’s service (ii) these terms and conditions (iii) terms and conditions of Celcom’s service.

Duration

The period of the Promotion shall commence from 11 January 2010 and shall continue until stocks last or any other dates to be determined by Celcom (“Promotion Period”).Any extension thereof shall be subject to Celcom’s sole discretion.

Eligibility

This Promotion is only applicable to all new and existing customers (“Customer”) and is only available at C-Mobile Sdn Bhd, Blue Cube outlets and Celcom’s authorized dealers.

 
Terms and Conditions of Promotion
 
1. Customer who wishes to participate in this Promotion may opt to subscribe to Celcom’s Easy Payment Plan (EPP) payment option and also bound by those terms and conditions governing EPP service thereof.The Customer must also make a separate application for Celcom’s Auto-billing (“Auto Billing”) which is applicable for settlement of periodic bills and the Customer shall be taken to have read and understand the terms and conditions of Auto Billing when participating in this Promotion.
2. For Customer who does not opt for EPP and new registration, shall be required to make an upfront payment of RM300 upon registration and subject to a stamp duty of RM 10 which will be reflected in the Customer’s 1st bill. For existing Customer with length of stay of less than twelve (12) months and the RM300 upfront payment shall be rebated over the Customer’s next 2nd to 6th billing cycles.
3. Customer must also subscribe to Celcom 3G Broadband Unlimited Plan (“Plan”) and hereby agrees to the prevailing tariff and rates specified in the said Plan.
4. All lines registered and subscribed by the Customer under this Plan must remained active for a minimum of twelve (12) months from the date of activation of Celcom’s Service or the Plan (“Minimum Subscription Period”).In the event of early termination within the Minimum Subscription Period, a penalty of RM500 in lieu of compensation shall be imposed and reflected in the bill of the Customer next billing cycle. In the event of early termination prior to the Minimum Subscription Period, any remaining rebate entitled from upfront payment shall be forfeited.
 
General Terms and Conditions
 
1. Celcom reserves the right to amend and omit and/or vary any of the terms and conditions of this Promotion without prior notice to the Customer herein stated and the Customer shall be bound to observe, perform and comply with the terms and conditions herein and any amendments thereof.
2. Celcom’s decisions in any matter in relation to the Promotion shall be final and conclusive. Any request for appeal and review shall not be entertained.
3. Celcom shall not be liable for any claims by the Customer or third-party claims or loses of any nature, including but not limited to, lost of profits, punitive, indirect, special, incidental, or consequential damages or for other damages and any related claims of any nature, including direct, indirect, third party, consequential or other damages resulting from or in connection with this Promotion.
4. Celcom shall not be responsible or liable for any claims of loss or damage to property or any personal injury or loss of life resulting from or in connection with this Promotion.
5. Celcom reserves the sole and absolute right to withdraw, amend and/or alter any part or the whole terms and conditions in relation to this Promotion at any time without giving any prior notice to the Customer and the Customer agree to be bound by those changes.
6. The Customer acknowledges and agrees that Celcom reserves the rights to disqualify any Customer, if found to be in breach of its obligations or any terms and conditions of this Promotion. Notwithstanding the above, Celcom reserves the right to reject any participation of Customer at its sole and absolute discretion without having to assign any reasons whatsoever.
7. Celcom does not take any responsibility in the case of an event that may prevent the Customer from participating in the Promotion, as a result of certain technical restrictions or other limitations specific or force majeure which include but not limited to regulatory events, government directive, act of God etc.
8. Any mobile phones and/or devices issued under this Promotion will be supplied by a third party and is sold separately. Celcom shall not be liable and disclaims any liability whatsoever of any claims against Celcom for any act of theft, stolen, defect, warranty and merchantability of the devices offered to the customer.
