TERMS & CONDITIONS FOR PEAK AND OFF PEAK PROMOTION (“Promotion”)
 

This Promotion is held by Celcom Mobile Sdn Bhd (27910-A) (“Celcom”).By participating in the Promotion, Customer hereby agree to be bound by these terms & conditions which shall form an integral part and to be read together with terms and conditions of Celcom’s service offered and relevant to the customer in respect to this Promotion.

In the event of a conflict or inconsistency between these terms and conditions and terms and conditions of Celcom’s service, such inconsistency shall be resolved by giving precedence in the following decreasing order (i) these terms and conditions (ii) Celcom Free Usage Policy and (iii) terms and conditions of Celcom’s service.

Promotion Period

The period of the Promotion shall commence from 9 am on 21 January 2010 and shall continue until 6:59:59pm 31 March 2010 (“Promotion Period”).Any extension thereof shall be subject to Celcom’s sole discretion.

Eligibility

This Promotion shall only be applicable to all customers who are on Celcom Executive 20, Celcom Executive 50 and Celcom 1+5 plan (“Customer”) and shall NOT BE APPLICABLE to Celcom’s prepaid, Celcom Biz or customers under any plan other than those stipulated herein.
This Promotion shall only be applicable to Celcom to Celcom domestic calls only.

The Promotion shall also not applicable for calls made between the Principle and Supplementary lines under the 1+5 Plan.

Promotion Mechanics

1. The Customer must subscribe either via one of the following options/method:

a) Via the *119# menu
Step 1 : Dial *119#
Step 2 : Select 4 to choose Celcom Exec Savers
Step 3 : Select 1 to Subscribe and then follow the instructions in the confirmation SMS to
subscribe.
   
2. Each subscription shall cost the Customer Ringgit Malaysia Three (RM 3) Only (“Subscription Fee”)
   
3. Each subscription shall only be deemed successful once a confirmation SMS is received by the Customer. The SMS confirmation will include the time period or duration during which the subscription will be valid (“Subscription Period”). The maximum Subscription Period for each day is from 9 am to 6:59:59 am.
   
4. After successfully subscribing, the Customer will enjoy the offer under this Promotion during the effective Subscription Period as defined in the confirmation SMS.
   
5. Notwithstanding the Promotion Period , the Subscription Period shall commence from 9 am and ends at 6.59 pm daily and after the Subscription Period , any Celcom to Celcom domestic calls made at 7 pm onwards will be chargeable at normal rate based on Celcom prevailing rates or based on the plan the Customer has subscribed.
   
6. Upon successful subscription, the Customer shall enjoy the first THREE (3) minutes of every Celcom to Celcom domestic calls during the effective Subscription Period for FREE. Celcom’s prevailing and normal charges shall apply above and more that the Three (3) Minutes and the Subscription Period.
   
7. During the Subscription Period, the first three (3) minutes of each Celcom to Celcom domestic calls will be rated and adjusted accordingly at the rate of 1 sen or any other amount to be determined by Celcom and shall be reimbursed in the Customer’s next bill in the following month.
   
8. The Subscription Fee shall only be applicable and used to determine which discount tiers of the Celcom Exec the Customer will be entitled to.  However, the Subscription Fee itself shall not be entitled to any discounts or waived.
   
9. The Customer’s line must be active to enjoy the benefits and rewards during the Subscription Period but no refund will be entertained should the Customer’s line be barred at any time.

General Terms and Conditions

1. Celcom reserves the right to amend and omit and/or vary any of the terms and conditions of this Promotion without prior notice to the Customer herein stated and the Customer shall be bound to observe, perform and comply with the terms and conditions herein and any amendments thereof.
   
2. Celcom’s decisions in any matter in relation to the Promotion shall be final and conclusive. Any request for appeal and review shall not be entertained.
   
3. Celcom shall not be liable for any claims by the Customer or third-party claims or loses of any nature, including but not limited to, lost of profits, punitive, indirect, special, incidental, or consequential damages or for other damages and any related claims of any nature, including direct, indirect, third party, consequential or other damages resulting from or in connection with this Promotion.
   
4. Celcom shall not be responsible or liable for any claims of loss or damage to property or any personal injury or loss of life resulting from or in connection with this Promotion.
   
5. Celcom reserves the sole and absolute right to withdraw, amend and/or alter any part or the whole terms and conditions in relation to this Promotion at any time without giving any prior notice to the Customer and the Customer agrees to be bound by those changes.
   
6. The Customer acknowledges and agrees that Celcom reserves the rights to disqualify any participant if the Customer is in breach of its obligations or any terms and conditions of this Promotion. Notwithstanding the above, Celcom reserves the right to reject any participation or Customer at its sole and absolute discretion without having to assign any reasons whatsoever.
   
7. Celcom does not take any responsibility in the case of an event that may prevent the Customer from participating in the Promotion, as a result of certain technical restrictions or other limitations specific or force majeure which include but not limited to regulatory events, government directive, act of God etc.
